SWMS for plumbers
Plumbers trip more high-risk construction work categories than almost any other trade. Trenches over 1.5 m, confined spaces, work near gas mains and live electrics, hot work in a flammable atmosphere, and asbestos pipes on every second renovation. Each one of those needs a SWMS (Safe Work Method Statement) under the Work Health and Safety Regulation 2011 (Qld) before you start. One generic "plumbing" SWMS doesn't cut it. Here's what a plumber's SWMS has to deal with, job by job.
Trenches: the 1.5 m rule
Regulation 291 makes work in or near a shaft or trench deeper than 1.5 m high risk construction work. A sewer connection on a sloping Gold Coast block gets there easily. The SWMS has to be written and signed before the excavator starts.
Two other duties kick in at the same time under the WHS Regulation:
- Underground services (reg 304). Before you dig, obtain current underground essential services information, have regard to it, and give it to the other duty holders on site. That's your Before You Dig Australia enquiry, plus a locator if the plans are vague. Hitting a gas main or an underground power cable is not a near-miss story, it's a funeral.
- Securing the trench (reg 306). A trench at least 1.5 m deep must be secured against unauthorised access. Fence it, sign it, and don't leave it open overnight for the neighbour's kids.
The collapse of an excavation, or of its shoring, is a dangerous incident under the WHS Act 2011 (Qld) and must be notified to Workplace Health and Safety Queensland. So your SWMS needs to say how you're stopping collapse: battering, benching, shoring or a trench shield, chosen for the actual soil. Coastal sand behaves differently to hinterland clay.
Confined spaces
Work in or near a confined space is high risk construction work. WorkSafe Queensland's examples include drainage and sewerage pipes and some trenches. Pits, tanks, under-floor voids and manholes all qualify if they're not designed for people to occupy and there's a risk from the atmosphere or engulfment.
Part 4.3 of the WHS Regulation adds its own requirements: an entry permit before anyone goes in, atmosphere testing, a stand-by person outside, training, and rescue equipment on hand. Hydrogen sulphide in a sewer will drop a bloke before he smells it. If you've only got one worker on the job, you don't have a confined space crew.
Hot work
Brazing, soldering, oxy cutting and grinding. Not high risk on their own, but the moment you're doing it in an area that may have a contaminated or flammable atmosphere, it's on the regulation 291 list. Think gas work, roof spaces full of dust and insulation, or a plant room with fuel.
The SWMS should cover isolating and purging gas lines before hot work, checking for flammables, an extinguisher at hand, and a fire watch after you finish. The number of house fires that start an hour after the plumber packs up is not small.
Working near services
Three separate categories from regulation 291 turn up on ordinary plumbing jobs:
- work on or near pressurised gas distribution mains or piping
- work on or near chemical, fuel or refrigerant lines
- work on or near energised electrical installations or services.
Gas fitting is licensed work in Queensland at any value through QBCC (Queensland Building and Construction Commission), and the SWMS is separate from the licence. For electrical, plumbers get caught out with hot water systems and pumps. Since 1 January 2025, the Electrical Safety Regulation 2013 (Qld) treats work within 3 m of an exposed energised part as work "near" energised equipment. The SWMS needs to say who isolates, how you confirm it's dead, and who is allowed to touch what. When in doubt, you don't touch it, the sparky does.
Asbestos pipes in renovations
Any house built before 1990 can have asbestos cement pipes, flues, eaves and wet-area sheeting. Work that involves, or is likely to involve, disturbing asbestos is high risk construction work. "Likely to" is doing a lot of work in that sentence. If you're cutting into an old bathroom, you're likely to.
The licensing rules in Queensland:
- You don't need a licence to remove 10 square metres or less of non-friable (bonded) asbestos, but the work still has to comply with Part 8.7 of the WHS Regulation and WorkSafe Queensland's code of practice.
- More than 10 square metres of non-friable asbestos needs a Class B licensed removalist.
- Any friable asbestos at all needs a Class A licence.
The SWMS should say: how you identify it (assume it's asbestos unless tested), how you keep it wet, what P2 respirator and disposable coveralls are used, how it's wrapped, labelled and disposed of, and where the line is that turns it into a licensed job. Then stick to that line. No grinding, no snapping, no power tools.
Putting the SWMS together
Regulation 299 says the SWMS must identify the high-risk work, state the hazards and risks, describe the controls, and say how they'll be implemented, monitored and reviewed. For a plumber that means one SWMS per task type: trenching, confined space entry, hot work, gas, asbestos, working near electrics. Keep them short and site-specific, get the crew to sign before they start, and keep them until the work is finished (two years if there's a notifiable incident).
Not having one is a breach of regulation 299, up to $6,000 per breach. Not having one when someone's buried in a trench is a Category 1 or 2 offence under the WHS Act 2011 (Qld), with maximums of $3 million and five years' jail for Category 1, and industrial manslaughter up to 20 years' jail and $10 million. The trench doesn't care whether you meant it. The paperwork is how you show you did the right thing.
