SWMS for painters: when you actually need one
Straight answer: painting is not on the high risk construction work list. Rolling a wall from the floor, cutting in off a step ladder, brushing a fence at knee height: none of that legally needs a SWMS (Safe Work Method Statement). You need one when the job around the painting is high risk under regulation 291 of the Work Health and Safety Regulation 2011 (Qld). For painters that mostly means falls over 2 metres, disturbing asbestos, confined spaces, working near live electrical services and working next to traffic. Lead paint has its own rules, which aren't the SWMS rules but bite just as hard.
What the regulation actually says
Regulation 291 lists 18 kinds of high risk construction work. Painting isn't one of them. Regulation 299 then says a SWMS must be prepared before high risk construction work starts. So the question is never "am I painting?" It's "does this painting job involve one of the 18?"
Plenty of builders demand a SWMS from every trade regardless. That's a contract requirement, not a legal one, and fair enough on a busy site. But know which is which. A SWMS for a ground-floor repaint is a box tick. A SWMS for a three-storey exterior is the law, and a document that could keep someone alive.
When a painter's SWMS is compulsory
- Risk of a fall over 2 metres. Exterior walls, eaves, gables, stairwells, double-height entries, roofs and gutters. Off a scaffold, a boom lift, a plank between trestles or an extension ladder, it doesn't matter. If the person could fall more than 2 metres, it's in.
- Disturbing asbestos. Pre-1990 fibro walls, eaves linings, soffits and old wet areas. Water blasting, sanding or wire brushing asbestos cement before you paint is disturbing it. That's high risk construction work and it's also regulated separately under the asbestos provisions.
- Confined spaces. Painting the inside of a tank, a pit or a plant room that meets the confined space definition. Fumes from solvent-based coatings in a space with poor ventilation are how painters die on industrial jobs.
- On or near energised electrical installations. Painting a switch room, or exteriors near service mains and overhead lines with a metal extension pole.
- On or adjacent to a road or other traffic corridor. Line marking, a fence on a road reserve, a commercial facade with cars a metre from the scaffold.
- Near moving powered mobile plant. A live construction site with a telehandler going past your scaffold.
Any one of those and you need the SWMS before you start, kept on site, and followed. One SWMS can cover several, as long as each hazard and its controls are spelled out.
Lead paint: not on the list, but regulated
Houses built before 1970 very often have lead-based paint under the newer coats, particularly on window frames, doors, skirtings, fascias, gutters and exterior walls. It's harmless while it's intact. It's a poison when you turn it into dust or fume.
The WHS Regulation (section 392 in Queensland) defines a "lead process", and painting-related work is on it: removing lead paint by dry sanding, heat or grit blasting, and spray painting with lead paint. If you're carrying out a lead process you have to assess whether it's lead risk work, and if it is, notify WHSQ (Workplace Health and Safety Queensland) and provide health monitoring, meaning blood lead testing by a doctor. That's a separate chain of duties to the SWMS regulation, and a lot of domestic painters have never heard of it.
The controls WorkSafe Queensland recommends belong in your procedure anyway: wet scraping, wet sanding, chemical strippers, drop sheets with raised edges to catch the slurry, a half face respirator with P2 filters, HEPA vacuum clean-up, no dry sweeping, sealed disposal. Don't burn it off. Don't power sand it dry without extraction. Don't hose the flakes into the garden where the kids play.
Hazards that don't trigger a SWMS but still need managing
Not needing a SWMS doesn't mean not needing controls. The general duty under the Work Health and Safety Act 2011 (Qld) applies to every job. For painters the common ones are:
- Falls under 2 metres. Trestles, planks and step ladders on tiled floors. Regulation 78 still requires you to manage it.
- Solvents and isocyanates. Two-pack coatings and spray work need ventilation, the right respirator and the SDS (Safety Data Sheet) on site.
- Manual handling. Twenty-litre drums up three flights of stairs.
- Silica. If you're grinding render, sanding fibre cement or cutting into concrete before you coat it, the crystalline silica rules that started 1 September 2024 apply to you too.
Cover these in a risk assessment or a simple safe work procedure. It doesn't have to be the full regulation 299 format, but it has to exist and it has to be real.
What a painter's SWMS should look like
Short. Job-specific. Written for the crew, not the lawyer. Regulation 299 wants four things: what the high risk work is, the hazards and risks, the controls, and how you'll implement, monitor and review them. Then the housekeeping: business name, address and ABN (Australian Business Number), site address, principal contractor if there is one, who's responsible, the date, and signatures from the workers you consulted. If the job changes, change the SWMS. If someone's not following it, stop the job.
A one-page SWMS that says "exterior repaint, 2-storey, scaffold with guardrails, EWP (Elevating Work Platform) for the gable, harness in the boom, eaves tested and confirmed no asbestos, wet sanding only" beats forty pages that mention everything and describe nothing.
